By accessing or using Merchantlify's website, mobile applications (Android and iOS), POS system, or delivery services, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not use our services.

Important: These terms apply to all users including merchants, delivery riders, and customers. Please read carefully before using our platform.

Merchantlify

The company providing the platform and services

Platform

Our website, mobile apps, POS system, and delivery services

Merchant

Business owner using our platform to manage operations

Rider/Delivery Partner

Individual providing delivery services

Customer

End-user purchasing goods or services through our platform

Services

All features and functionalities provided by Merchantlify

3. Account Registration

3.1 Account Creation

  • You must be at least 18 years old to create an account
  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • You agree not to share your account credentials

Security Notice: Merchantlify will never ask for your password via email or phone. Report any suspicious activity immediately.

4. User Obligations

  • Use services in compliance with all applicable laws
  • Do not engage in fraudulent or illegal activities
  • Respect intellectual property rights
  • Maintain the confidentiality of your account
  • Do not interfere with platform operations

5. Prohibited Activities

  • Impersonating others or providing false information
  • Using the platform for illegal purposes
  • Distributing malware or harmful code
  • Attempting to gain unauthorized access
  • Violating any applicable laws or regulations

6. Intellectual Property

  • All content and materials are owned by Merchantlify
  • Trademarks, logos, and service marks are our property
  • You may not copy, modify, or distribute our content
  • Your content remains your property
  • You grant us license to use your content

7. Service Availability

  • Services are provided on an 'as is' basis
  • We strive for 99.9% uptime
  • Scheduled maintenance may cause downtime
  • We reserve the right to modify or discontinue services
  • Not responsible for third-party service interruptions

8. Payment Terms

For Merchants

  • Subscription fees are billed monthly or annually
  • Transaction fees apply per successful sale
  • Payment processing fees are clearly displayed
  • Refunds are subject to our refund policy

For Delivery Riders

  • Earnings are calculated based on deliveries completed
  • Payouts are processed weekly
  • Tips are fully retained by the rider
  • Minimum payout thresholds may apply

9. Termination

  • Either party may terminate with written notice
  • We reserve the right to suspend or terminate accounts
  • Immediate termination for policy violations
  • You can delete your account at any time
  • Data retention policies apply after termination

10. Limitation of Liability

  • Services provided 'as is' without warranties
  • We are not liable for indirect or consequential damages
  • Maximum liability limited to fees paid
  • We are not responsible for third-party actions
  • Force majeure exemptions apply

11. Dispute Resolution

Governing Law

These Terms are governed by the laws of the jurisdiction where Merchantlify is established.

Arbitration Agreement

Any disputes shall be resolved through binding arbitration rather than in court.

Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class actions.

Merchantlify processes your personal data in accordance with our Privacy Policy. By using our platform, you agree to our data collection and processing practices.
